By accessing and using Hoot's services, you accept and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not access or use our services.
Hoot provides automation tools for Business Center creation, Business Center top ups, and Engagement jobs. The platform uses separate credit balances for Business Center Credits and Engagement Credits. Services may be available, paused, under maintenance, or limited to beta access depending on system status, account health, capacity, and operational requirements.
To use our services, you must create an account by providing accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Credits are purchased in advance and are non-refundable for cash or other payment methods. Business Center Credits may be used for Business Center creation and top-up services. Engagement Credits may be used for Engagement jobs. Credits have no cash value, are not a stored-value account, and may only be used inside Hoot for the credit type and services they were purchased for.
When a Hoot service is active and accepts an order, Hoot guarantees delivery of the paid successful output or a credit-only correction to your Hoot account. For Business Center creation, Business Center Credits are deducted only after successful delivery of credentials to your vault, and failed creations return the affected credits to your Hoot balance. For Engagement jobs, Engagement Credits may be reserved when an order is accepted, but failed or undelivered items are not charged and reserved credits are released back to your available balance. This guarantee does not create any right to a cash refund.
Hoot may enforce limits on order size, daily usage, queue capacity, account availability, cooldowns, rate limits, and service access. These limits may differ between Business Center services and Engagement services and may change at our discretion to maintain system stability, delivery quality, and service safety.
You agree not to use our services for illegal activity, abuse, harassment, fraud, platform manipulation, or activity that violates third-party platform policies. You are solely responsible for the links, comments, account usage, campaigns, assets, and instructions you submit to Hoot. Hoot may reject, pause, cancel, or limit orders that appear unsafe, abusive, unsupported, or harmful to our infrastructure or service quality.
Hoot may rely on third-party platforms, services, networks, APIs, browsers, account systems, and payment processors. Hoot does not control third-party platform availability, moderation decisions, account restrictions, policy changes, outages, or rate limits. Delivery guarantees apply only to Hoot credits and Hoot-controlled order fulfillment while the applicable Hoot service is active.
Hoot reserves the right to terminate or suspend your account and access to the services at our sole discretion, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or targets the integrity of our infrastructure (e.g., reverse engineering or unauthorized API scraping). Upon termination, your right to use the Service will cease immediately, and any remaining credits may be forfeited.
You agree to defend, indemnify, and hold harmless Hoot, its founders, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the Service; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.
Hoot shall not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to third-party account suspension, content removal, loss of ad spend, campaign downtime, lost profits, lost data, or service interruption. To the maximum extent permitted by law, our total liability shall not exceed the amount you paid for credits in the 30 days preceding the claim.
These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Hoot operates, without regard to its conflict of law provisions.
We reserve the right to modify these Terms of Service at any time. Continued use of our services after changes constitutes acceptance of the modified terms.
